Privacy Notice

This Privacy Notice (“Privacy Notice”) is provided by Alpha Galaxy Group and its subsidiary companies (referred to as “the Company”, “we”, “our” and “us”). This Privacy Notice is formulated in accordance with the Personal Data Protection Act 2010 (Act). We may vary or update this Privacy Notice from time to time. Please check our Website regularly for updates to our Privacy Notice.

A. General

The personal data about you which we may collect including but not limited to your name, postal and email addresses, identity card (MyKad) numbers, other contact details, identification details, and other information relevant to you, which we receive from you through all forms and/or documents submitted and/or collected by us, or through all electronic forms or documents submitted to us via the Company's website, or any information obtained independently by us from other lawful sources.

B. Purpose

We may use and process any of your Personal Data for business and activities of the Company which shall include, but not limited to:

• Performing any of our obligations in respect of any contract entered into with you;
• Providing you with any services or products you have requested;
• Processing your application under any of the Company's tender or work-in-progress;
• Facilitating or process payments relating to any products or services you have provided;
• Processing your participation in any events, activities, or research studies;
• Performing statistical analysis for various objectives in the Company and providing this information within the Company;
• Promotion and marketing emails with information about our products and services;
• Complying with any requirements to make disclosures under any laws and regulations and other regulatory requirements binding on us or any of our group companies and affiliated companies;
• All other purposes relating thereto.

We may either contact you for the purpose as set out in (B) above via telephone calls, emails, short message services, social media or by whatsoever form of available communication.

Where sensitive personal data is provided, and disclosed by you to the Company, by such disclosure, you have consented to its collection, and processing by the Company.

Consequences of not providing Personal Data

• The failure to supply us with the required personal data will potentially:
• Result in us being unable to enter into a service contract or agreement with you;
• Result in us being unable to communicate notices, value-added services and updates to you;
• Affect our capacity to accomplish the above stated purposes.

C. Disclosure

You further agree that the Company may disclose and transfer (whether in Malaysia or abroad) your information:

• To our related companies, affiliates, advisors, agents, consultants, solicitors, auditors, employers, contractors, suppliers, partners, joint venture partners, advertisers, purchasers, network operators, service providers, any relevant authorities, embassies, statutory bodies, regulatory bodies, organisations or any relevant financial institutions, any other persons under a duty of confidentiality to the Company, actual or proposed assignees or transferees or buyers of any of rights/businesses/assets of the Company, service providers (including those who assist us in providing the Company's website), for the purposes of operational, administration, development and maintenance requirements of our business or our Website.
• To other third parties for the purpose of (B) above for and on behalf of the Company.
• As required or authorised under law or provided in co-operation with any governmental authority.

D. Storage and Retention

We may store your personal data either in electronic or hard copy form or retain third parties to hold that information on our behalf (whether in Malaysia or abroad).

Any personal data supplied by you will be retained by the Company as long as necessary for the fulfilment of the purposes stated in (B) above or is required to satisfy any legal, regulatory and/or accounting requirements or to protect the Company's interests. We will destroy or de-identify when any personal data is no longer needed.

E. Security

The Company shall take appropriate measures to protect the personal data from any loss, misuse, modification, unauthorized or accidental access or disclosure, alteration or destruction when processing personal data.

The Company shall take necessary steps to store and process your personal data securely. We will undertake the following security steps:

• Implementation of a formal information security policy and necessary technology controls such as firewall, password controls, physical security, logging and monitoring etc;
• Process controls such as segregation of duties, defined roles and responsibilities and need-to-know basis for staff;
• Third party providers and contractors storing or processing personal data have implemented similar acceptable standards of security.

However, as the Website is linked to the internet, no data transmission over the internet can be guaranteed as completely secure. So while the Company strives to protect such personal data, the Company cannot ensure or warrant the security of any personal data transmitted to the Company via the Website and you do so at your own risk.

F. Data Integrity

You hereby confirm that you have obtained the consent from the persons or companies represented by you for you to provide their respective personal data to us for the purposes as set out in (B) above and disclosed to parties stated in (C).

All personal data supplied by you to the Company shall be accurate, complete, and not misleading.

G. Data Retention

Your personal data will be stored for only the period as necessary to fulfill the purposes stated above after which we proceed to ensure that your personal data is destroyed, anonymised or permanently deleted if it is no longer necessary to store. Reasons to further store your information even after the fulfillment of the purposes include:

• To satisfy legal, regulatory or accounting requirements;
• To protect the interest of the Company.

Language

As per Section 7(3) of the PDPA, this notice and consent form is issued in both English and Bahasa Malaysia. In the event of any inconsistency, the terms of the English version shall prevail.

Bahasa Malaysia

1. Notis Privasi ini (Notis Privasi) disediakan oleh Alpha Galaxy Group dan anak-anak Syarikat (dirujuk sebagai “Syarikat” dan “kami”). Notis privasi ini digubal mengikut Akta Perlindungan Data Peribadi 2010 (Akta). Kami mungkin mengubah atau mengemaskinikan notis privasi ini dari semasa ke semasa. Sila rujuk kepada Laman Web kami untuk kemaskini ke atas notis privasi kami.

A. Umum

Data peribadi anda yang dikumpul oleh kami termasuk tapi tidak terhad kepada nama anda, alamat pos dan emel, nombor kad pengenalan (MyKad), lain-lain maklumat untuk dihubungi, maklumat pengenalan dan lain-lain maklumat yang berkaitan dengan anda yang kami terima daripada anda melalui pelbagai bentuk dan/atau dokumen yang diberikan dan/atau yang dikumpul oleh kami atau melalui bentuk elektronik atau dokumen yang diberikan kepada kami melalui Laman Web Syarikat, atau lain-lain maklumat yang kami dapati secara persendirian daripada sumber-sumber yang sah.

B. Tujuan

Kami mungkin menggunakan atau memproses data peribadi anda untuk tujuan perniagaan dan aktiviti Syarikat termasuk, tetapi tidak terhad kepada:

• Menjalankan tanggungjawab kami berhubung dengan apa-apa kontrak yang telah kami adakan dengan anda;
• Menyediakan apa-apa perkhidmatan atau produk yang anda minta;
• Memproses permohonan anda di bawah apa-apa tender oleh Syarikat atau kerja yang sedang dijalankan;
• Memproses pembayaran berhubung dengan apa-apa produk dan perkhidmatan yang anda telah berikan;
• Memproses penyertaan anda di dalam apa-apa aktiviti atau kaji selidik;
• Melaksanakan analisa perangkaan untuk pelbagai objektif di dalam Syarikat dan menyediakan maklumat ini kepada Syarikat;
• Emel promosi dan pemasaran dengan maklumat berhubung dengan produk dan perkhidmatan kami;
• Memenuhi sebarang keperluan untuk membuat pendedahan di bawah mana-mana undang-undang dan peraturan-peraturan dan lain-lain keperluan kawal selia yang tertakluk ke atas kami atau anak-anak Syarikat yang lain;
• Lain-lain tujuan yang berkaitan.

Kami boleh, samada menghubungi anda untuk tujuan seperti yang dinyatakan dalam perkara (B) di atas melalui panggilan telefon, emel, khidmat pesanan ringkas, media sosial atau pun melalui apa juga bentuk komunikasi yang ada.

Akibat Tidak Membekalkan Butiran Data Peribadi Anda

Kegagalan untuk membekalkan kami dengan data peribadi yang diperlukan mungkin:

• Menyebabkan kami tidak dapat meneruskan ke dalam kontrak perkhidmatan atau perjanjian dengan anda;
• Menyebabkan kami tidak dapat berkomunikasi notis, perkhidmatan nilai tambah dan maklumat terkini kepada anda;
• Menjejaskan keupayaan kami untuk mencapai tujuan seperti dinyatakan di atas.

C. Pendedahan

Anda selanjutnya bersetuju bahawa Syarikat boleh mendedahkan dan memindahkan maklumat anda (samada di dalam Malaysia atau luar negara):

• Kepada mana-mana syarikat dalam kumpulan Syarikat, syarikat-syarikat bersekutu, ejen, perunding, peguam, pengaudit, majikan, kontraktor, pembekal, rakan kongsi, ahli gabungan bersama, pengiklan, pembeli, pengendali rangkaian, pembekal perkhidmatan, mana-mana pihak berkuasa, kedutaan, badan berkanun, badan kawal selia, mana-mana institusi kewangan berkenaan, orang perseorangan yang di bawah tugas kerahsiaan terhadap Syarikat, pemegang serah hak atau penerima pindahan atau pembeli samada sebenar atau yang dicadangkan bagi apa-apa hak/perniagaan/aset dalam Syarikat, pembekal perkhidmatan (termasuk mereka yang membantu kami dalam penyediaan Laman Web Syarikat) untuk keperluan operasi, pentadbiran, pembangunan serta pengendalian perniagaan atau laman web kami.
• Kepada pihak ketiga untuk tujuan yang dinyatakan dalam perkara (B) di atas dan bagi pihak Syarikat.
• Seperti yang dikehendaki di bawah undang-undang atau disediakan sealiran dengan mana-mana penguatkuasa kerajaan.

D. Penyimpanan dan Pengekalan Data Peribadi

Data peribadi anda akan disimpan dalam bentuk elektronik atau salinan cetak atau mengekalkan pihak ketiga untuk menyimpan maklumat tersebut bagi pihak kami (samada dalam Malaysia atau luar negara).

Data peribadi yang anda berikan akan disimpan oleh Syarikat selama mana yang perlu untuk menyempurnakan tujuan-tujuan yang dinyatakan di dalam perkara (B) di atas ataupun untuk keperluan undang-undang, kawal selia dan/atau perakaunan atau untuk melindungi kepentingan Syarikat. Kami akan menghapuskan apa-apa data peribadi yang tidak lagi diperlukan.

E. Keselamatan

Pihak Syarikat akan mengambil langkah-langkah yang sesuai untuk melindungi data peribadi daripada hilang, disalah guna, diubah, didedahkan atau akses yang tidak dibenarkan atau tidak sengaja, pengubahan atau pemusnahan ketika memproses data peribadi.

Kami akan mengambil langkah-langkah yang perlu untuk menyimpan dan memproses data peribadi anda dengan selamat. Kami akan melaksanakan langkah-langkah keselamatan berikut:

• Pelaksanaan dasar keselamatan maklumat formal dan kawalan teknologi yang perlu seperti “firewall” , kawalan kata laluan, keselamatan fizikal , log dan pemantauan, dan lain-lain;
• Kawalan Proses seperti pengasingan tugas , garis panduan bagi peranan dan tanggungjawab, dan “need-to-know basis” untuk kakitangan;
• Pembekal pihak ketiga dan kontraktor yang menyimpan atau/dan memproses data peribadi telah melaksanakan standard keselamatan yang serupa.

Walau bagaimanapun, oleh kerana Laman Web mempunyai pautan ke internet, penghantaran data melalui internet tidak boleh dijamin sebagai selamat sepenuhnya. Oleh itu, walaupun Syarikat berusaha untuk melindungi data peribadi tersebut, Syarikat tidak dapat memastikan atau menjamin keselamatan sebarang data peribadi yang dihantar kepada Syarikat melalui laman web dan anda berbuat demikian atas risiko anda sendiri.

F. Integriti Data

Anda, dengan ini mengesahkan bahawa anda telah beroleh kebenaran daripada orang perseorangan atau syarikat-syarikat yang diwakili oleh anda untuk anda memberikan data peribadi mereka kepada kami bagi tujuan-tujuan yang disebutkan dalam perkara (B) di atas dan didedahkan kepada pihak-pihak yang disebutkan dalam perkara (C).

Semua data peribadi yang diberikan oleh anda kepada pihak Syarikat adalah tepat, lengkap dan tidak mengelirukan.

G. Pengekalan Data Peribadi

Maklumat peribadi anda akan disimpan untuk hanya tempoh yang diperlukan untuk menepati tujuan yang dinyatakan di atas dan selepas itu kami akan memastikan bahawa data peribadi anda akan dihapuskan secara selamat, tanpa mendedahkan anda atau dipadam secara kekal jika ia tidak lagi perlu disimpan. Sebab-sebab lain untuk pihak kami menyimpan maklumat anda walaupun selepas menepati tujuan termasuk:

• untuk memenuhi undang-undang, keperluan peraturan atau perakaunan;
• untuk melindungi kepentingan Syarikat.

Bahasa

Seperti Seksyen 7 (3) PDPA , notis ini dan borang persetujuan diterbitkan dalam kedua-dua Bahasa Inggeris dan Bahasa Malaysia. Sekiranya berlaku apa-apa inkonsistensi, syarat-syarat versi Bahasa Inggeris akan diguna pakai.

No Warranties

This website is provided "as is" without any representations or warranties, expressed or implied. Alpha Galaxy Group makes no representations or warranties in relation to this website or the information and materials provided on this website.

Without prejudice to the generality of the foregoing paragraph, Alpha Galaxy Group does not warrant that:

• this website will be constantly available, or available at all; or
• the information on this website is complete, true, accurate or non-misleading.

Nothing on this website constitutes, or is meant to constitute, advice of any kind.

Limitations of Liability

Alpha Galaxy Group will not be liable to you (whether under the law of contract, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this website:

• for any indirect, special or consequential loss; or
• for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.

Exceptions

Reasonableness

By using this website, you agree that the exclusions and limitations of liability set out in this website disclaimer are reasonable. If you do not think they are reasonable, you must not use this website.

Other Parties

You accept that, as a limited liability entity, Alpha Galaxy Group has an interest in limiting the personal liability of its officers and employees. You agree that you will not bring any claim personally against Alpha Galaxy Group's officers or employees in respect of any losses you suffer in connection with the website.

Without prejudice to the foregoing paragraph, you agree that the limitations of warranties and liability set out in this website disclaimer will protect Alpha Galaxy Group's officers, employees, agents, subsidiaries, successors, assigns and sub-contractors as well as Alpha Galaxy Group.

Unenforceable Provisions
